BlogOverdrive is a trade name under which
Internet Marketing Tech, Inc, does business
relating to the BlogOverdrive system. All users
of the BlogOverdrive system and service are
required to agree to the following Terms of Use
and Conditions. Anyone determined by
BlogOverdrive to have violated these Terms of
Use and Conditions is subject to service
termination without any obligation by
BlogOverdrive or Internet Marketing Tech, Inc.
Exclusive Use
The BlogOverdrive system is for the exclusive
use of webmasters and web site managers. The
following types of sites are NOT PERMITTED to
use the BlogOverdrive system for any reason:
sites encouraging illegal activity or racism,
sites providing instructions or discussions
about performing illegal activities, sites
engaged in libelous or harassing activities,
sites that promote or utilize software or
services designed to deliver unsolicited email,
sites that utilize multiple pop-ups or sites
that trap users with pop-ups or JavaScript (or
similar means) and sites that are otherwise
inappropriate.
By agreeing to these Terms, you understand and
agree that Internet Marketing Tech, Inc. has the
sole and exclusive right to limit the use of the
BlogOverdrive service and to permit or deny in
its sole discretion the use thereof.
Pricing
Pricing for your BlogOverdrive account is based
on the package you have selected at sign-up. By
agreeing to these Terms of Use and Conditions,
you hereby understand and agree that the account
fee will be charged to your credit card every
month.
You may upgrade your package at any time and by
doing so authorize us to charge your credit card
each month for the price of the upgraded
package. You may downgrade your package at any
time; however we do not refund the difference in
package prices. The new downgraded price will be
charged to your credit card each month beginning
with your next billing period.
Trial and Special Offers
Blog Overdrive reserves the right to discontinue or modify trial or promotional offers at our discretion. The Free Offer associated with Blog Overdrive entitles registered subscribers to the free usage of the service with the limitations specified. We reserve the right to cancel at any time, for any reason and without notice any subscribers free account.
Cancellations and Refunds
You have the right to cancel at any time, however
please understand you must cancel in writing via
your BlogOverdrive account. Cancellation in
writing is for the security of all parties. In
the event that a billing dispute arises,
activity logs and email archives allow us to
research and resolve disputes promptly. If you
cancel your account, you will Not be entitled to a refund
for any unused portion of your package. There are no refunds for
accounts that have been cancelled for violation
of these Terms of Use and Conditions.
Any user issuing chargeback’s against
BlogOverdrive is subject to immediate account
termination without warning.
Ownership and Rights
Internet Marketing Tech, Inc. retains ownership
and all rights to the BlogOverdrive name, logo,
software, web site, all data, and related
proprietary information. BlogOverdrive users
may not use the BlogOverdrive name or logo or
any confusingly similar variations or
modifications for monetary gain or profit
outside of the rights outlined in this
agreement.
Liability
The BlogOverdrive system is protected from
network outages with redundant T3 connectivity
to the internet, and is protected from power
outages with electric generators and other
backup systems. Although we will make a
reasonable effort to provide a very high
standard of quality for our services, no
guarantees of any kind regarding the
dependability or timeliness of the services of
BlogOverdrive can be made and are not being
made. All users agree to utilize the
BlogOverdrive services at their own risk. It is
specifically agreed that Internet Marketing
Tech, Inc., or the BlogOverdrive system
administrators, partners and sponsors may not be
held liable for any damage to or loss of data or
any information that may occur from the use of
the BlogOverdrive system or services.
Intellectual Property
The information provided to users of the
BlogOverdrive system may be proprietary in
nature. Users of the BlogOverdrive system and
service acknowledge that they are not
competitors of BlogOverdrive, and agree not to
share this information with any competitors of
the BlogOverdrive system. Anyone
misappropriating or copying intellectual
property from this website will be prosecuted to
the fullest extent of international law. You
agree not to copy, access or distribute the
BlogOverdrive.com programming code. You
acknowledge that you are not a competitor of
BlogOverdrive.com or have joined to obtain
knowledge of our proprietary system. A violation
of this section would entitle us to at least
$100,000 damages.
Proper Use
BlogOverdrive uses RSS feeds to post to users
blog account. Many websites have terms and
conditions related to the use of their RSS feeds
that prohibit commercial use of the feed or
using a RSS posting system like BlogOverdrive.
WITH LITERALLY HUNDRED’S OF THOUSANDS OF RSS
FEEDS AVAILABLE FOR YOUR USE WITH BLOGOVERDRIVE,
IT IS YOUR RESPONSIBILITY TO REVIEW EACH RSS
FEED’S TERMS AND CONDITIONS RELATED TO ITS USE
AND YOU SHALL AGREE TO ABIDE BY THOSE CONDITIONS. WE RESERVE
THE RIGHT TO IMMEDIATELY CANCEL YOUR ACCOUNT
SHOULD WE FIND YOU IN VIOLATION OF ANY RSS FEED'S
TERMS AND CONDITIONS.
You understand that any examples or samples of
RSS feeds used in the BlogOverdrive.com website
are simply for illustration purposes. We have
not reviewed and you shall not assume that we
have reviewed ANY RSS feeds
Terms of Use - IT IS SOLELY YOUR RESPONSIBILITY
TO REVIEW EACH RSS FEED’S TERMS OF USE TO
DETERMINE IF ITS USE WITH BLOGOVERDRIVE WOULD
VIOLATE THOSE TERMS.
Indemnification
As a user of the BlogOverdrive system you hereby
agree to defend, indemnify and hold Internet
Marketing Tech, Inc. harmless from and against
any and all claims, losses, liability costs and
expenses (including but not limited to
attorneys' fees) arising from your violation of
this Agreement or any third-party's rights,
including but not limited to infringement of any
copyright, violation of any proprietary right
and invasion of any privacy rights. This
obligation will survive any termination of this
Agreement.
The quality of the BlogOverdrive brand is
directly related to the websites that utilize
our service. For this reason, all users must
read and agree to the following Terms of Use and
Conditions before registering for a
BlogOverdrive account. If you are unable to
agree to the Terms of Use and Conditions, you
will not be able to utilize a BlogOverdrive
account. If you agree to the Terms of Use and
Conditions, and at a later time do not follow
these guidelines, your account will be
terminated or suspended without notice. |
